Maryland Statute of Limitations Personal Injury
The statute of limitations is a law which limits how long injury victims have to file a personal injury claim before they lose their legal right to do so. According to the Maryland Courts & Judicial Proceedings Code section 5-101, the statute of limitations for personal injury cases in the state of Maryland is three years.
Specifically, this means you have three years from the date your injury occurred to file your claim, or you will lose your right to file and recover compensation. It’s important to note that exceptions exist that can change this time limit. The most notable exceptions include:
- If the injury victim was a minor at the time of the accident, the three-year time period will begin once the claimant turns 18.
- If the injury victim has a condition that qualifies them as legally mentally incapacitated, the statute of limitations will end two years from the date they are declared mentally capable again.
- If the alleged negligent party intentionally conceals their identity to avoid a lawsuit the three-year clock won’t start until the injury victim discovers the fraud
